No “New” Illinois Medicaid Rules Yet

On September 13, 2011 at its monthly meeting, the Illinois Joint Committee on Administrative Rules (JCA R) voted to maintain the Prohibition on Illinois’s proposed new Medicaid rules. As you have read in past posts, Illinois is required to issue new rules implementing Medicaid for long-term care regarding nursing homes, and supported living facilities, etc., in order to come into compliance with the federal Deficit Reduction Act of 2005 (DRA). At the meeting, JCAR indicated that Illinois needs to continue to revise the  rules with the input of  stakeholders in order to make sure that the proposed rules  prevent harm to seniors who have made transfers in the last five years relying on the old rules, and to avoid having the proposed rules  be more strict than the federal DRA requires.
